Moroccan property law has two forms side by side: registered property with a title of ownership and unregistered property that exists only in notarial or traditional deeds. This article explains what that distinction means for your case, how family ownership after an inheritance works and which documents an investigation can yield. How we carry out the investigation on site is something we discuss with you for each case.

Home

Knowledge base

Real estate in Morocco: registered and unregistered property

Registered property: the titre foncier

Registered real estate in Morocco has a titre foncier: a unique title number with the description of the plot, the owner or owners, their shares and the encumbrances on it, such as a mortgage. Registration has a strong legal effect in Morocco: what is in the titre foncier is deemed to be the ownership situation.

For your case, this means: an extract of a titre foncier describes the ownership on the date of issue, with the shares of all co-owners. New-build apartments in cities are usually registered in this way, often in the name of the buyer themselves.

Unregistered property: melk and moulkia

A large part of the real estate in Morocco, especially in rural areas and older urban districts, is not registered. That property is called melk. Ownership is proven by a moulkia, a deed drawn up by two adouls, traditional notaries, and homologated by the court.

For your case, this means:

a negative outcome for registered property does not exclude unregistered property;

for unregistered property, the moulkia and the associated deeds are the documents that demonstrate ownership;

a property may be in transition to registration; that procedure can take a long time.

Please therefore state in your request everything you know about the municipality or region of origin. After a death, the property passes to the heirs under Moroccan inheritance law, with different shares for the children and the surviving spouse. The division is recorded in a deed of inheritance, but registration in the names of the individual heirs is often omitted.

Someone can thus be co-owner of the parental home or of agricultural land without their name appearing in a register. The share is nevertheless ownership. For the means test for the living wage (leefloon) it counts as a resource; for the Flemish property ownership condition, only full ownership has counted since 1 October 2025, but the reduction for the years before that date remains recoverable. See the Court of Cassation judgment on a plot in Morocco, which still applied the old rule strictly. In the case of co-ownership or acquisition by inheritance, it may therefore be important to investigate further both the ownership share and the date and method of acquisition; the deed of inheritance and the deed of the original property are the key documents in this respect.

What a pre-check and an in-depth investigation deliver

A pre-check gives a first picture: are there indications of real estate in the name of the person concerned in Morocco?
