The Council of State (Raad van State) found this contrary to the principle of equality. The Flemish Government has adjusted the rule: since 1 October 2025, only full ownership excludes. On 17 September 2024, in ruling no. 260.645, the Council annulled the provisions of the Besluit Vlaamse Codex Wonen (Flemish Housing Code Order) that treated prospective tenants and tenants with only a partial right in rem the same as full owners, at registration, at admission and during the tenancy.

The reasoning: a share of a dwelling or a limited right is often not saleable and does not necessarily provide the means to provide for one’s own housing. Treating both groups identically violates the principle of equality, and administrative simplicity cannot justify this. To avoid legal uncertainty, the Council maintained the effects of the annulled provisions until 31 December 2025. According to VRT NWS, approximately fifty households had at that point been evicted from their social housing for this reason.

The new rule since 1 October 2025

On 5 September 2025, the Flemish Government approved an amendment to the Besluit Vlaamse Codex Wonen, in force since 1 October 2025. The main points:

Full ownership remains excluded. Anyone who owns a dwelling or building plot entirely in full ownership, or holds a full right of usufruct, long lease (erfpacht) or right of superficies (opstal), in Belgium or abroad, cannot rent a social housing unit. A sitting tenant who acquires such a property is given a period to sell it and must otherwise leave.

Partial ownership no longer counts. Anyone who owns a share of a dwelling or building plot, for example from an inheritance or gift, may keep that share and still rent social housing or remain a candidate.

Anti-abuse rule. Anyone who, in the three years before registration, deliberately gave away or sold a share of their dwelling in order to meet the condition remains excluded.

Same rules for social owner-occupied dwellings, social building plots, rental deposit loans and special social loans.

For tenants who owned a share before 1 October 2025, the old rule continues to apply for that period. The Court of Cassation (Hof van Cassatie) still applied it strictly on 26 March 2026; read the ruling.

What this means for investigations abroad

The new rule changes the question an investigation must answer, not its importance.

Full ownership abroad remains the core. A house or apartment registered entirely in the tenant’s name, in Türkiye (Turkey), Morocco or elsewhere, excludes social renting, exactly as before 2025. In practice, this accounts for the majority of hits.

In the case of co-ownership, the date counts. Since 1 October 2025, an inherited share no longer excludes, but the social rent reduction for the period from 1 March 2017 to 30 September 2025 remains recoverable if the tenant concealed the share at that time. The report must therefore state the method of acquisition and the date of acquisition; we do this as standard.

Full usufruct, long lease (erfpacht) and right of superficies (opstal) remain excluded and occur regularly abroad, for example a parent who holds the usufruct of the family home.

Living wage: nothing has changed. The Flemish property ownership condition applies to social renting.
